Approved Program Provider Application

This performance agreement is intended to ensure consistent and high-quality delivery of the NRFSP Food Handler program and to ensure compliance with the procedures related to the examination. Please read the following expectations and conditions carefully.

By checking the boxes next to each statement, you are committing to National Registry of Food Safety Professionals (NRFSP) that you will follow these standards as a Registered Approved Program Provider (APP) and that you agree and accept all the conditions and requirements stated herein.

Program Providers must submit documentation every three years to maintain Approved status. In order to be approved as a Program Provider for the National Registry’s First Principles for Food Handlers Program, you must:

Provide information relating to your food safety and/or training experience
Possess and maintain a valid Food Manager Certification from an ANSI-accredited provider. When your certification expires, you are expected to send National Registry your new certificate
Incorporate coursework within a logical sequence and follow the Intended Learning Outcomes as provided by National Registry

To become an Approved Program Provider, please complete the following information then submit to National Registry.

To offer food handler training in Arizona, California, Hawaii, Illinois, New Mexico or Texas, you must be an Approved Program Provider.

Please attach a copy of your valid food manager certificate, resume or job description, along with relevant business documentation.

AGREEMENTS

I am aware of the ethical responsibility I hold as an APP. I understand that any indication of impropriety or misconduct, during or outside the event of class instruction, exam administration or failure to follow NRFSP policies, shall be grounds for immediate revocation from any administrative responsibilities for all NRFSP programs.I understand that while providing NRFSP Food Handler classroom instruction, I am, at that time, operating solely as an independent contractor to NRFSP and not as an employee, agent or representative, and that I will refer to myself as an Approved Program Provider. APPs are responsible for ensuring that these important lessons are taught in a clear and consistent manner. I understand that when I proctor the exam I am responsible for maintaining the confidentiality of the test contents and adhering to the standards and ethics of secure Exam Administration.I agree and understand that NRFSP may communicate updates, changes, and other information to me by electronic mail, U.S. Mail, or other means.I agree to provide every examinee the Candidate Information Sheet that explains both the examinees’ rights and the NRFSP Food Handler training program, prior to the start of the course.When delivering a Food Safety Class that is called: NRFSP Food Handler, I agree to use available NRFSP instructional materials, media, and methods in the delivery of the program.I will abide by all copyright guidelines set forth in NRFSP materials. I will only reproduce or alter NRFSP materials that are explicitly stated that can be duplicated or altered for which I have received written permission from NRFSP. I will not portray NRFSP content or materials with my own logo.I am aware of and will follow the policies established by NRFSP that ensure the confidentiality of the examination contents and of secure exam administration. These examination policies and procedures are outline in the NRFSP Approved Program Provider Manual. I have read the Manual and understand the penalties for violating the standards.I will comply with the procedures regarding handling any breaches of security that might occur before, during, and after and examination and understand that NRFSP will investigate any allegations of exam security violations.I will not administer the examination to anyone which may result in a conflict of interest. For example, a family member or friend is unacceptable.I will not review or reveal the contents of any examination at any time without the express written permission of NRFSP.I understand that I am responsible for conducting classes and/or administering the examination in accordance with guidelines set by the local regulatory agency. (Please check with your local health and/or regulatory agency regarding the training and examination administration requirements for your area.) Additionally, I will comply with all current policies implemented by NRFSP.I understand that NRFSP has the right to audit any courses I instruct and/or exams I administer for quality assurance purposes with or without any advanced notice to me.I am aware that the penalties for violation standards (provided in the NRFSP Approved Program Provider Manual or this Performance Agreement) may include, but are not limited to: warning, probation, temporary suspension of course instruction and/or proctoring privileges, revocation of course instruction and/or proctoring privileges at will, civil or criminal action, other action NRFSP considers appropriate.I understand that NRFSP may notify third parties of penalty actions, with or without prior notice to me. These parties include, but are not limited to: educational institutions, government, health and regulatory agencies, employers, law enforcement agencies.I understand that information concerning my status as a Registered Approved Program Provider may be shared with NRFSP affiliates, transferees, and assignees.

CONFIDENTIALITY AGREEMENTS

I understand that score reports are considered privileged and strictly confidential information. The only individuals authorized by NRFSP to distribute scores and certificates to examinees are as follows: NRFSP or its designee, the examinees’ registered instructor, the examinees’ employer, and appropriate health/regulatory agencies.I agree to maintain all information with reference to any candidate with special needs, or any individual assisting a special-needs candidate as strictly confidential and privileged information. I understand that I may be held liable for damages resulting from any breach of this obligation.I understand that all information gathered on examinees requiring special arrangements or accommodations in accordance with the Americans with Disabilities Act (ADA) is proprietary and confidential information. This includes information on individuals who assist examinees with special needs. I agree to not disclose to any other person any confidential information on examinees needing special accommodations as defined under the ADA.I agree to maintain all information with reference to any examinee with special needs, or any individual assisting a special-needs candidate as strictly confidential and privileged information. I understand that I may be held liable for damages resulting from any breach of this obligation. I also understand and agree that NRFSP has the right to suspend or revoke my right to instruct and administer exams at any time at its discretion for any reason NRFSP believes is in the best interest of the NRFSP Food Handler Program.I agree that this Performance Agreement shall be governed by, construed in accordance with, and enforced solely in the state of Florida. I agree that any claim or action relating to this Performance Agreement shall be commenced exclusively in an appropriate court in the state of Florida, and I hereby waive any objection to personal jurisdiction that I may otherwise have.
